| El caso de pacientes, en estado vegetativo persistente es uno de los más emotivos que se presenta ante los tribunales. Desde el caso Nancy Cruzan v. Missouri, los tribunales americanos deciden que la alimentación artificial podría entrañar manipulación del cuerpo del paciente sin su consentimiento. Pensamos, con la jurisprudencia, que la clave es cuando el cuidador trata de interrumpir la nutrición e hidratación de alguien en estado vegetativo persistente, y no, lo que dicen los activistas de la eutanasia, es decir el problema sobre la libertad o la equidad de la causa. |

Summary: The article studies the anthropologic statute of the “brain-dead” patient. Though most of the experts thin k that these people are actually dead, some authors assume that because the organic functions are still present in these people, it is hard to determine their death. Supported by aristothelic anthropology, the article defends the idea that it is possible to consider the physiologic remanent events as “life” , but “vegetative life”, absolutely and irreversibly separated from the sensitives and intelec- tual faculties. In addition, this situation is considered as a state of inviability for the patient, because it entails the total and irreversible loss of the unity of the person. Then, it is possible to affirm that, at the current state of the technology, death –if determined by neurologic criteria- is not compatible with the soul-body union. So vital phenomena exposed in the corpses aren’t human life itself, but simple vital residual dynamism, supported in artificial way. |

ABSTRACT The report from the Organ Donation Taskforce looking at the potential impact of an opt-out system for deceased donor organ donation in the UK, published in November 2008, is probably the most comprehensive and systematic inquiry to date into the issues and considerations which might affect the availability of deceased donor organs for clinical transplantation. By the end of a thorough and transparent process, a clear consensus was reached. The taskforce rejected the idea of an opt-out system. In this article we acknowledge the life saving potential of organ transplants and seek to highlight the difficulties that arise when the issue of organ shortage competes with concerns over choice and authorisation in the context of deceased donor organ donation.
